1. How can I find out the zoning of a particular property and what the property can be used for?

Zoning for a property can be obtained by calling the Planning Division at 626-308-2806. Planning staff can tell you the zoning designation for a particular property, the uses permitted, and the development standards for that particular zone. 2. How do I find out how much I can build on my property?

There are development standards for each zoning designation in the City. The Planning Division at 626-308-2806 can provide the zoning designation and development standards for your property, including setbacks, height limits, and lot coverage. For example, if your property is located in the R-1 zone (single-family residential), the total lot coverage allowed is 35% of the lot size. Select the link for more information.

3. What is a variance and how do I apply for one?

A variance is an exception to land use regulations. A request for a variance is the process by which an applicant can seek a deviation from the zoning and development regulations for a property. When unnecessary hardships or the inability to develop the property occur from a strict interpretation of the zoning code, a property owner may apply for a variance.

The Planning Commission is the hearing body for a variance and must make strict findings of fact in order to approve a variance. The burden of proof is on the person applying for the variance to demonstrate that an unusual hardship exists due to the physical characteristics of the property. The Planning Commission cannot consider financial hardships when deciding on a variance. To apply for a variance, ask the Planning Division to help you fill out the Development Review Application Checklist. It will help you determine exactly what is required.

4. If I have a building that does not comply with today's zoning standards on my property, can I rebuild the building if it has been damaged or destroyed?

Yes, the City's Municipal Code says that such "legal nonconforming" buildings can be completely rebuilt if involuntarily destroyed, such as by fire or earthquake. The new building would have to placed in exactly the same location as the old building and can be no larger than the original.

6. How do I find out if a commercial/residential property complies with current codes and zoning requirements?

You can meet with a Planner and with representatives from the Building and Neighborhood Improvement Services divisions to discuss the existing conditions on your property and how they comply with current codes.
